Interrogations are a very specific component of any criminal investigation. The answers gained through interrogative process provides information that are considered as direct evidences. In contemporary criminal procedure, the court is not absolved from gaining other evidences, even in cases when the defendant confesses his/her guiltiness. This is a mechanism for excluding the inquisitorial approach for extracting compulsory confessions. The modern procedure uses a variety of mechanisms to guarantee that the defendant will not be compelled to confess guilt. Those mechanisms (...) are part of most important international conventions as International Convention for Civil and Political Rights, the European Convention on Human Rights, the American Convention on Human Rights, the Statutes of International Tribunals and part of different constitutional and legal acts of modern states. A very interesting “highlight” remains the right to silence which guarantees that the defendant might remain silent and it will not be interpreted against him. The defendant, even in cases with direct evidences, can remain silent and cannot be forced to answer given questions. Another “highlight” is that one that appears from the privilege against self-incrimination that allows the defendant to not answer a question, if by answering, he/she may confess guilt or incriminate him/herself. How deep is this privilege? Are there, maybe questions, that he/she are obliged to answer The article will focus in interrogations and the right to silence by most important international acts and domestic acts of different countries and upcoming specifics in the relation interrogations vs. remaining silent. The aim of this research is to analyze the political discourse and the language they used in public addresses provided by two former presidents of the United States, specifically, President Barak Obama and President Donald Trump. This research reflects on the material that has been collected for several months which aimed to contribute on the analysis of the corpus, distinctions and similarities, as well as their attitudes towards the public opinion. The objectives of this study are mainly empirical and theoretical. (...) Considering the empirical objectives, this study seeks to explore, identify and categorize the most used words in a political speech according to the categories, form, function and meaning, whereas, the theoretical objectives of this study are to provide a description of the language that is used in major events from well-known politicians when aiming to capture people’s attention. Their rhetorical habits were examined, in every delivery of Mr. Obama’s political speech; his speeches were carefully and well-articulated throughout his 8 year political service in the oval office, portraying him as a kind person. On the other hand, Mr. Trump’s, as a non-politician, more as a businessman, political speeches throughout his campaign and 4 years in the office were very often seen as aggressive, unforeseen, and nonetheless straight to the point. This study covers the linguistic level analysis as well as semantic and pragmatic levels. Initially, the selected corpora were analyzed using the Ant Conc software regarding frequency of usage and then move into detailed analysis. (shrink)

Everybody who has learned English as a second or foreign language knows that for reaching intermediate levels, English is an easy language regarding grammar and vocabulary; however, when reaching advanced levels, the learners are faced with complex forms of morphology, syntax, and most obviously, they are faced with the difficulties that pronunciation presents. These are mainly the problems that occur with the English students whose native language is other than English. An experienced teacher of non-native speakers of English can easily (...) recognize the causes of mispronunciation, which in most cases are lack of vocabulary, lack of practice, bad teaching experiences, lack of direct contact with the language, and lack of self-confidence. There are quite a lot of words in English, which are often mispronounced. Those who have just started to learn English as a foreign language, students at primary schools, adults using English as a means of communication and as a working tool, such as businessmen, politicians, administrators, doctors, accountants, and those studying English for teaching purposes, even the teachers of English are faced with the problems of proper pronunciation of words in English.The aim of this research is to identify the problems that the students in the Department of English Language and Literature in the Faculty of Languages, Cultures and Communication face with when they deal with pronunciation of lexical words. According to the standard analysis of degree questions, the logical form of a degree question contains a variable that ranges over individual degrees and is bound by the degree question operator how. In contrast with this, we claim that the variable bound by the degree question operator how does not range over individual degrees but over intervals of degrees, by analogy with Schwarzschild and Wilkinson's proposal regarding the semantics of comparative clauses. Not only does the interval-based semantics predict the existence (...) of certain readings that are not predicted under the standard view, it is also able, together with other natural assumptions, to account for the sensitivity of degree questions to negative islands, as well as for the fact, uncovered by Fox and Hackl, that negative islands can be obviated by some properly placed modals. Like Fox and Hackl, we characterize negative island effects as arising from the fact that the relevant question, due to its meaning alone, can never have a maximally informative answer. Contrary to Fox and Hackl, however, we do not need to assume that scales are universally dense, nor that the notion of maximal informativity responsible for negative islands is blind to contextual parameters. Children are the most sensitive part of a sciety, therefore the violence against them is considered a serious violation of their personal rights and their higher interests. In most of cases, children in Republic of Macedonia are very little or not at all informed concerning the possibilities of reporting the cases of violence against them by their parents or relatives. The issue of domestic violence is still considered a private problem which occurs within the home. Thus, in most of cases, (...) this problem remains unsolved in silence, without any alert for the state institutions or SOS phone lines for reporting domestic violence. Some children who are more aware for being subjected to violation of their rights are afraid to report the case because of further consequences. In this article some facts will be given about observing the symptoms and signs of violence against children, forms and types of violence against children, determination factors of the violence as well as the consequences and the impact of the domestic violence on the physical and psychological development of children. Based on the legal provisions and international conventions, parents, responsible institutions and the society in general are morally and legally obliged to respect and preserve the interest of the child. This article will show that in practice, these legal obligations are violated by parents and in specific cases also by the competent institutions because the lack of intervention. (shrink)

The aim of this study is to explore the role and the importance of the notary service in the process of dejudicialization of the judicial-civil protection. In this context, this paper first of all attempts to examine the extent to which the issues from the traditional competence of the court have been transferred to notary publics and the possibilities of further extension of this transfer. The judicial framework for the transfer of these issues from the court competences to that of (...) notary publics has been decided by the Law on Non-Litigious Procedure. In supporting this law, the notary publics undertook the realization of a series of activities in this field, namely in the field of inheritance. In this respect, the idea of this paper was to try to identify other judicial issues that could perhaps be entrusted to the notary publics in the future, by carrying out a judicial-political assessment of the public interest to transfer the resolution of certain issues to notary publics′ competences with the aim of facilitating the judicial circulation and increasing judicial security. The aim is to investigate the Information Communication Technology on GDP growth in Western Balkan countries from 2000 - 2019. Different econometric techniques were used such as pooled OLS, fixed effects, random effects, and the Hausman Taylor model with instrumental variables. The findings indicate that fixed telephone subscriptions and individuals using the internet have a positive effect on GDP growth, while the fixed broadband subscriptions and mobile cellular subscriptions have a negative effect on GDP growth. The results also show general (...) government final consumption has a negative effect on GDP growth, whereas foreign direct investment has a positive effect on GDP growth, but the coefficient is statistically insignificant. The study will serve for policy makers to invest more in ICT since this will contribute to the economic growth and welfare benefits. There is no study that has been analyzed about ICT in Western Balkan countries, thus findings will be valuable to the government. (shrink)

In the contemporary family law, parents are obliged to arrange the joined implementation of the parenting rights either by their own will or through the help of their lawyers and/or mediators. This institute of mutual agreement is known as joined custody or joined implementation of the parenting right after the divorce of the marriage. This institute makes it possible for parents who live separately to arrange their custody rights in the most convenient way for the child. With a joined custody (...) agreement, the parents accept the obligation to implement all the rights and duties that constitute the parenting right even in case of their separation. Through not dividing their rights from their obligations and with the aim of being closer to the needs of the child, the institute of joined custody helps avoid the feelings of hostility and disagreement in regard to the judicial decision which gives permanent custody to one of the parents. This institute is incorporated in the family law of many countries. This article aims to emphasize the need to introduce in the family law of RM an explicit provision for joined and responsible custody after the divorce in order to achieve the best interest of the child. There is a joined initiative of parents who live separately from their children who request the amendment of the Family Law of RM in this direction. (shrink)

This collection features five essays from noted theologians, philosophers, geneticists, and biologists who discuss the sweeping impact of Charles Darwin's _On the Origin of Species_ on their respective fields. This volume, edited by Ralph Buchsbaum, professor of biology at the University of Pittsburgh, was published to celebrate the centenary of Darwin's announcement in 1858, along with Alfred Russel Wallace, of their independent discovery of the process of natural selection. Darwin's book was published one year later.

Domestic violence is one of the most serious forms of violation of basic human freedoms and rights regardless of ethnicity, gender, religion, and status. A reflection on many international statistics shows that women are the most frequent victims of domestic violence. Based on the definition of the phenomenon of domestic violence, the forms of abuse, the manner how violence is treated, the possibility of children, men, extramarital spouses, brothers, sisters, and old people living in an extended domestic community, of also (...) being victims is not excluded. Since domestic violence is not only a national problem but a worldwide problem, international organizations have worked towards the eradication of this phenomenon by sanctioning it in various international conventions. Also, the legal systems of many countries prohibit and sanction domestic violence by special laws obliging the state authorities to act in all situations when there are indications that there are direct or indirect violent acts in a family. In this paper, the authors present only the domestic violence against children as an evident problem in families, but which is often unreported. The legal frameworks of the Republic of North Macedonia and Republic of Kosovo are presented in this paper with the aim to describe the material-legal and procedural-legal treatment of domestic violence by pointing out the failure of the state authorities in implementing the laws on protection and prevention of this phenomenon. The authors take the approach of only treating the legal consequences of child abuse by parents that in both legislations is deprivation of parental rights for the violent parent. They conclude that the state authorities should intensify their work in taking control measures towards all the families where there are suspicions that the parental rights are neglected, and the child is abused. Because many cases of abuse have not been detected or reported, and in both countries a special study especially on domestic violence against children does not exist, the possibility that the number for this type of child abuse is great. Through the methodology of content analysis and based on the Web of Science database and through the MAXQDA software, this document analyzes and reviews the ten most important theories and models of technology acceptance used in recent years. Authorship Analysis (AA) is a natural language processing field that examines the previous works of writers to identify the author of a text based on its features. Studies in authorship analysis include authorship identification, authorship profiling, and authorship verification. Due to its relevance, to many applications in this field attention has been paid. It is widely used in the attribution of historical literature. Other applications include legal linguistics, criminal law, forensic investigations, and computer forensics. This paper aims to provide an (...) overview of the work done and the techniques applied in the authorship analysis domain. The examination of recent developments in this field is the principal focus. Many different criteria can be used to define a writer’s style. This paper investigates stylometric features in different author-related tasks, including lexical, syntactic, semantic, structural, and content-specific ones. A lot of classification methods have been applied to authorship analysis tasks. We examine many research studies that use different machine learning and deep learning techniques. As a means of pointing the direction for future studies, we present the most relevant methods recently proposed. The reviewed studies include documents of different types and different languages. In summary, due to the fact that each natural language has its own set of features, there is no standard technique generically applicable for solving the AA problem. (shrink)

In this paper the authors present the psychological consequences of social isolation on domestic violence during the Covid-19 pandemic as well as the legal framework in the RNM on addressing the phenomenon of domestic violence. In this age of globalization and drive for material conformity, family life is quite difficult to cope with. This “war” for material comfort during the pandemic, has strained and stressed many families as a result of the created circumstances. Public safety measures, including physical distance and (...) social isolation, which have also been implemented in the RNM have contributed in making family problems even more pronounced. Social distance and staying at home are very effective in reducing the transmission of Covid-19 virus, but these safeguards disrupt the routines of spouses and families. Domestic violence affects a large number of families, and it is estimated that in times of social isolation, all forms of violence have been inflicted against family members regardless of their gender and age. The most common forms of domestic violence during Covid-19 pandemic in our country are psychological, physical and economic violence. Some countries affected by Covid-19 have seen increases in levels of domestic violence, including violence against children, violence against partners, and violence against the elderly. This paper presents the results of research conducted which highlight the fact that during the Covid-19 pandemic, there has been an increase in levels of domestic violence in the Republic of North Macedonia in the first six months of 2020. The authors give their recommendations on the need for action by state institutions during the Covid-19 pandemic in order to adapt methods and circumstances towards the protection of victims of domestic violence. L ’article examine des armoiries situées sur la margelle d’un puits dans la forteresse médiévale d’Arta. Ces armoiries ont été publiées en 1936 par A. Orlandos, qui les a attribuées à la famille italienne dite des Orsini, présente à Arta au xive s. L ’article démontre qu’il faut, au contraire, les attribuer à une autre famille italienne, celle des Tocco, ayant régné à Arta de 1416 à 1449. Il décrit leur composition associant aux armoiries de la famille (...) Tocco elle‑même celles des princes de Tarente, empereurs titulaires de Constantinople, ainsi que la célèbre aigle bicéphale byzantine. Il étudie la signification des armoiries en les replaçant dans le contexte de l’héraldique familiale des Tocco, de celle des familles occidentales liées au monde byzantin et de celle de Byzance. Enfin, il étudie leur postérité dans les armoiries ultérieures des descendants de la famille. (shrink)

Theodosius Dobzhansky has long been recognized by historians as a pioneer in the combining of the 'field natural history' and 'laboratory experimentalist' traditions in biology (Allen 1994). The following essay analyzes two papers in his wellknown Genetics of Natural Populations series, GNP IX and GNP XII, which demonstrate how Dobzhansky combined field and laboratory work in the pursuit of an evolutionary question. The analysis reveals the multiple and complementary roles field observations and experiments played in his investigations. But it (...) also identifies several interpretive problems associated with the use of intervention that limited the effectiveness of his approach. The essay argues that these problems reflect a fundamental tension between the amount of control Dobzhansky had over the circumstances of his experiments and the applicability of his results to natural populations. It concludes that this trade-off represents an important distinction between experiments in biology and most other sciences. (shrink)

This paper is a contribution to our understanding of the constructive nature of Greek geometry. By studying the role of constructive processes in Theodoius’s Spherics, we uncover a difference in the function of constructions and problems in the deductive framework of Greek mathematics. In particular, we show that geometric problems originated in the practical issues involved in actually making diagrams, whereas constructions are abstractions of these processes that are used to introduce objects not given at the outset, so that their (...) properties can be used in the argument. We conclude by discussing, more generally, ancient Greek interests in the practical methods of producing diagrams. (shrink)

In Fall 1939, as war engulfed Europe, the author of one of the most influential texts on genetics and evolution, Theodosius Dobzhansky, wrote a letter to curator of insects at the United States National Museum, Edward Albert Chapin. Dobzhansky wished to know what Chapin thought about his pursuing some taxonomic work on an old fascination of his: lady-bird beetles. This paper examines the resulting correspondence as a window into Dobzhansky’s attitude toward taxonomy, the different pressures on geneticists and taxonomists (...) when wrestling with how to name species, the relation between biological theory and taxonomic practice, and how claims regarding human races may have motivated Dobzhansky’s continued interest in the work of beetle taxonomists. In doing so, this article builds on the work of Paul Farber and others to highlight the importance of including museums, taxonomy, and the naturalist tradition within the history of twentieth-century biology. This article attempts to provide a summary of the European and Greek philosophy of the 16th century, so that the contribution of the two Zygomalas to philosophical education can be evaluated along with the philosophical preferences of their cycle. Contributions of this study would be considered the restoration of incorrect positions in the bibliography concerning the doctor-philosopher Leonardo Mindonios and the analysis of the philosophical corpus in Istanbul in the second half of the 16th century.

I reconstruct the relationship between the evolutionary geneticists Theodosius Dobzhansky (1900–1975) and Richard Lewontin (1929–2021). Using archival research and published texts, I show that Lewontin inherited his dissertation director’s research program as well as his “biology of democracy.” He did so in circumstances in which the molecular revolution in genetics was threatening both Dobzhansky’s science and his anti-racist social ideals. Lewontin’s sometimes rocky relationship with the person he called “my professor” sprang from his perception that Dobzhansky was not up (...) to managing the research program that Lewontin received from him. I explain how Lewontin took charge and the role his Marxist interpretive lens plays in his argument. (shrink)

The use of ‘race’ as a proxy for population structure in the genetic mapping of complex traits has provoked controversy about its legitimacy as a category for biomedical research, given its social and political connotations. The controversy has reignited debates among scientists and philosophers of science about whether there is a legitimate biological concept of race. This paper examines the genetic race concept as it developed historically in the work of Theodosius Dobzhansky from the 1930s to 1950s. Dobzhansky’s definitions (...) of race changed over this time from races as ‘arrays of forms’ or ‘clusters’ in 1933–1939, to races as genetically distinct geographical populations in 1940–1946, to races as genetically distinct ‘Mendelian populations’ in 1947–1955. Dobzhansky responded to nominalist challenges by appealing to the biological reality of race as a process. This response came into tension with the object ontology of race that was implied by Dobzhansky’s increasingly holistic treatment of Mendelian populations, a tension, the paper argues, he failed to appreciate or resolve. Conceptions of adaptation have varied in the history of genetic Darwinism depending on whether what is taken to be focal is the process of adaptation, adapted states of populations, or discrete adaptations in individual organisms. I argue that Theodosius Dobzhansky’s view of adaptation as a dynamical process contrasts with so-called “adaptationist” views of natural selection figured as “design-without-a-designer” of relatively discrete, enumerable adaptations. Correlated with these respectively process and product oriented approaches to adaptive natural selection are divergent pictures of (...) organisms themselves as developmental wholes or as “bundles” of adaptations. While even process versions of genetical Darwinism are insufficiently sensitive to the fact much of the variation on which adaptive selection works consists of changes in the timing, rate, or location of ontogenetic events, I argue that articulations of the Modern Synthesis influenced by Dobzhansky are more easily reconciled with the recent shift to evolutionary developmentalism than are versions that make discrete adaptations central. On the one hand, much has been written on Theodosius Dobzhansky’s central role in the development of the field of population genetics and modern evolutionary theory, as well as on his sociopolitical worldview in the middle of the Twentieth Century. On the other hand, much has also been written on Dobzhansky’s role in the institutionalization of genetics in Brazil, where he spent a considerable amount of time. Unfortunately, these literatures developed without any points of intersection or cross-reference. Spherical geometry studies the sphere not simply as a solid object in itself, but chiefly as the spatial context of the elements which interact on it in a complex three-dimensional arrangement. This compels to establish graphical conventions appropriate for rendering on the same plane—the plane of the diagram itself—the spatial arrangement of the objects under consideration. We will investigate such “graphical choices” made in the Theodosius’ Spherics from antiquity to the Renaissance. Rather than undertaking a minute analysis of every (...) particular element or single variant, we will try to uncover the more general message each author attempted to convey through his particular graphical choices. From this analysis, it emerges that the different kinds of representation are not the result of merely formal requirements but mirror substantial geometrical requirements expressing different ways of interpreting the sphere and testify to different ways of reasoning about the elements that interact on it.
